Terms and Conditions

BOOKINGS


1. The hiring of The Tipsy Mare Australia is done on a first to book basis. 

2. To secure your booking of The Tipsy Mare Australia a 15% deposit is required and a signed Hire Agreement returned. Should both of these not be done by the due date we reserve the right to hire to another client. 

3. The hire of The Tipsy Mare Australia does not include alcohol. Clients should stock their own choice of alcohol.


4. The final balance stated in your Hire Agreement must be paid within 24 hours of the event date. 

5. The right to accept or refuse a booking is at the discretion of The Tipsy Mare Australia. 


DELIVERY, SET-UP, TAKE-DOWN & DEPARTURE


6. Delivery of The Tipsy Mare Australia will be as agreed in your Hire Agreement. 

7. The Client shall be responsible to ensure that the site is cleared and ready for the delivery of The Tipsy Mare Australia and that the foundations upon which it is to be positioned are sufficiently firm and otherwise suitable. 

8. Hiring of The Tipsy Mare Australia will only be ‘to’ and ‘from’ the date and times specified in the Hire Agreement. Any extension of the period needs to be agreed to and will incur additional fees at $200 per hour.

9. Distance travelled over 30kms from The Tipsy Mare Australia’s premises located at Mudgee NSW 2850 will incur an additional travel cost which will be quoted on application.

10. No refunds will be issued if the Client requests an early departure of The Tipsy Mare Australia.


USE OF EQUIPMENT 


11. Alcohol will not to be served to guests under 18 years of age. 

12. Under no circumstances shall liquor be sold until the necessary liquor permit is sighted before the event by The Tipsy Mare Australia.

13. It is the responsibility of the Client to obtain any other necessary permits from the relevant authorities as required for planned activities.

14. Broken or chipped glassware will incur a replacement cost of $5 per glass.

15. No alterations, modifications, attachments to the walls, floors or signs will be made to any part of The Tipsy Mare Australia without prior permission. 

16. No food should be prepared in or served from The Tipsy Mare Australia.

17. Persons authorised by The Tipsy Mare Australia shall at all times be entitled to free access to all areas of the Client’s event. 

18. No responsibility will be accepted for private property left on or near The Tipsy Mare Australia. 

19. In poor weather conditions locking up The Tipsy Mare Australia may be necessary and our assessment shall be final. 

20. The Tipsy Mare bar staff reserve the right under the conditions of RSA to stop serving any individual who is intoxicated. 

21. If any members of The Tipsy Mare staff are subjected to threats or abusive language the bar will close immediately unless the individual/s are removed from the event. No refunds will be issued if The Tipsy Mare is forced to close due to this situation.


CANCELLATION POLICY


22. No cancellation by the Client is valid unless it has been acknowledged in writing by The Tipsy Mare Australia at tipsymare@yahoo.com 

23. The Client may cancel a booking at any time although the following fees will apply: 

· Bookings cancelled less than 30 days prior to the booking will be charged 50% of the total booking; and

· Bookings cancelled with 30 days or more notice will be charged $100 cancellation fee.

24. Cancellations of bookings due to weather will be charged $100 cancellation fee. 

25. The Tipsy Mare Australia may cancel a booking by written notice to the Client at any time before the date of hire if we become aware that the event is in any way objectionable, dangerous, is prohibited by law or would be otherwise be detrimental to The Tipsy Mare Australia.


CLIENT’S LIABILITY


26. The Client will pay full replacement or repair costs of any part of The Tipsy Mare Australia badly damaged, lost or stolen including burns, holes, tears, water damage due to them or their guests.

27. It will be decided by The Tipsy Mare Australia if damages can be repaired or require replacement. 

28. In the event of The Tipsy Mare Australia being stolen from the event site, the Client shall notify tipsymare@yahoo.com in writing stating the full circumstances of the theft, the time the police were notified and a police report number. 

29. The Tipsy Mare Australia shall not in any event be liable for contingent, consequential, indirect, special, and punitive or any other similar damages, howsoever caused, for any damage, injury or loss, whether arising under breach of contract, negligence (commission, omission or advice), and strict liability or otherwise. 

30. This Hire Agreement will be governed and constructed in accordance with the laws of the state of NSW, the parties submit to the jurisdiction of the Courts of that state for determination of any dispute claim or demand arising out of these Terms & Conditions.

31. The Tipsy Mare Australia shall in no way be held responsible or accountable for any injury, death or loss of income caused to the Client, any third parties or properties due to the hire of The Tipsy Mare Australia.

32. In the case of any disputes arising, the decision of The Tipsy Mare Australia will be final.
